Car Wash Noise Nuisance

Richard Buxton Solicitors represented the residents of a Grade II* listed property in Dover living next to a car wash business causing excessive noise. 

The residents made a claim of statutory nuisance in the Folkestone Magistrates’ Court, alleging that the car wash operations, including the use of jet powered pressure washers, soap guns, and high-powered vacuums, were an unreasonable interference with the enjoyment of their home.

The residents alleged that the operator Ramyar Hand Car Wash Ltd, the site manager Rawand Karim, and the landowner Daniel Funnell, were each responsible for the noise.

Before the matter was heard by the Court, the operator applied for voluntary strike off from the Companies Register and its manager left the site.  A new company, Ramyar Car Wash Dover Ltd took over the site.

On the morning of the hearing, the residents settled their claim with the landowner and the Court made the abatement order sought by consent, requiring the operator and the landowner to comply with a series of restrictions to abate the nuisance within one month.  The landowner was ordered to pay a contribution to the residents’ costs in bringing the claim.
