Distribution Centre noise nuisance

Richard Buxton Solicitors represented the residents of a narrowboat moored on the Grand Union Canal in west London suffering the effects of noise from a 24-hour distribution centre. 

The residents made a claim of statutory nuisance in the Uxbridge Magistrates’ Court, alleging that the operations of the distribution centre were causing an unreasonable interference with the enjoyment of their narrowboat home, including disturbances to sleep.  The residents alleged that the operator, Lloyd Fraser Logistics Ltd, as well as its landlord SEGRO (Fairways Industrial Estate) Ltd, were each responsible for the noise.

Lloyd Fraser eventually agreed to cease their operations at the site and the parties negotiated over an appropriate contribution to the residents’ costs in bringing the application.  Before the matter could be resolved, Lloyd Fraser was placed into administration and ceased trading, at which point the alleged nuisance was abated.

The residents reached a settlement of their claim with the landlord, SEGRO, shortly before it was due to be heard in court.  The case against Lloyd Fraser has been discontinued.
